What Is the Partner Visa?

The Subclass 820 Partner Visa is a temporary visa that allows the spouse or de facto partner of an eligible Australian resident to live in Australia while the Subclass 801 Permanent Partner Visa is being processed.

Eligibility Criteria:

To apply, you must:

  • Be in Australia at the time of lodging the application
  • Be the spouse or de facto partner of:
    • An Australian citizen
    • An Australian permanent resident
    • An eligible New Zealand citizen
  • Have a sponsor, usually your partner, who must be approved by immigration
  • Meet relationship requirements at the time of application and at the time of decision
  • Not have had a visa cancelled or a visa application refused while in Australia
  • Not be subject to condition 8503 or any other restriction preventing onshore application
  • Meet health and character requirements
  • Have or obtain adequate health insurance (You may be eligible for Medicare)

With a Subclass 820 Partner Visa, you can:

  • Live in Australia temporarily while your permanent visa (Subclass 801) is processed
  • Work and study in Australia
  • Travel in and out of Australia as many times as needed
  • Access Medicare, Australia’s public healthcare system
  • Attend free English classes under the Adult Migrant English Program (if eligible)

How Long Can You Stay?

You can stay in Australia until a decision is made on your Subclass 801 Permanent Partner Visa or until you withdraw your application.

Visa Costs

The fee covers both Subclass 820 (Temporary) and Subclass 801 (Permanent) applications:

  • Most applicants: AUD 9,095.00
  • Prospective Marriage visa (Subclass 300) holders: AUD 1,515.00
  • If your Subclass 300 visa expired and you didn’t apply on time: AUD 1,920.00
  • Additional charges apply for each family member included in the application

Including Family Members

  • Family unit members who hold or have held a Subclass 300 (Prospective Marriage Visa) can be included
  • You cannot add new family members after the 820 application is submitted

Health & Character Requirements

  • Health Requirement: You and any family members applying must undergo a medical exam.
  • Character Requirement: Police certificates must be provided for all countries you’ve lived in for 12+ months.

Partner Visa – Subclass 801 (Permanent)

How Long Can You Stay?

  • This is a permanent visa.
  • You become a permanent resident on the day the visa is granted.
  • Your initial travel facility lasts for 5 years from the grant date.

Eligibility Requirements

To apply for the Subclass 801 visa, you must:

  • Hold a temporary Partner visa (Subclass 820) or a Dependent Child visa (Subclass 445)
  • Wait 2 years from the date of lodging your combined Subclass 820/801 visa application
  • Still be in a genuine, ongoing relationship with your sponsor
  • Meet health and character requirements

Continue to Meet Relationship Criteria

You must still be in a genuine and committed relationship with the partner who originally sponsored you. This includes:

  • Being married or in a de facto relationship
  • Living together (or not living permanently apart)
  • Having a mutual commitment to a shared life
  • Excluding all other romantic partners

Health & Character Requirements

  • You and any dependents must meet Australia’s health requirements
  • Police clearance is needed to satisfy character requirements
  • These conditions apply to both accompanying and non-accompanying family members
