Who Is Eligible for an Open Work Permit?

You may qualify for a Canada Open Work Permit if you are:

• A spouse or common-law partner of an international student, a skilled foreign worker, or an applicant under the Atlantic Immigration Program
• A dependent family member of someone applying for permanent residence
• A refugee, protected person, or their family member
• A temporary resident permit holder
• An individual being sponsored for permanent residence as a spouse or dependent child
• A victim of abuse on an employer-specific permit
• A Quebec investor with a Notice of Intent to Select

Open Work Permits for Family Members

As of January 21, 2025, changes affect eligibility for family members of foreign workers. Eligible family members include:

• Spouses, common-law, or conjugal partners of workers in high-skilled occupations (TEER 0, 1, and select TEER 2 and 3 roles)
• Accompanying dependent children of those applying for or already holding permanent residence with an Acknowledgement of Receipt (AOR)

To qualify, the sponsored family member must:

• Be in a genuine relationship with the primary applicant
• Be living in Canada with the sponsor
• Be included in a valid permanent residence application

Fees and Processing Times

• Total cost: CAD $255 (Work Permit Fee: CAD $155, Open Work Permit Holder Fee: CAD $100)
• Processing time: typically 3 to 27 weeks, depending on country of residence and whether the application is inside or outside Canada
